By accessing or using the services provided by The Zephlex (“we,” “us,” or “our”), including ordering short-form video editing, website builds, or related services through our website, you (“Client” or “you”) agree to the following Terms of Service.

1. Services

The Zephlex provides professional services in the following areas:

  1. Short-Form Video Editing
  • Editing services for platforms such as Instagram Reels, TikTok, and YouTube Shorts.

  • Revisions apply only to videos we edit and are subject to the terms outlined in the corresponding Statement of Work (SOW).

  • Any services requested outside the scope of a signed SOW require a new SOW.

  1. Website Builds and Maintenance
  • Website build packages include Starter Site and Business Site options, as detailed in the Letter of Agreement (LOA).

  • Optional maintenance plans are available for ongoing updates, security, and minor edits.

  • Revisions for website builds are limited to minor adjustments before final delivery, unless otherwise agreed in a new LOA.

2. Ordering and Payment

  • Video Editing: Full payment for video editing services is required upfront before work begins.

  • Website Builds: Full payment for website build services is required upfront before the final website is delivered or transferred to the client.

  • Maintenance plan payments are recurring monthly via Stripe until canceled by the client.

  • Work will not commence until payment has been received.

  • Additional services or edits outside the agreed scope require a new LOA or SOW and separate payment.

3. Prohibited Actions

Clients agree not to:

  • Use delivered content or websites for illegal purposes.

  • Copy, scrape, or otherwise reproduce our website, proprietary content, or pre-built assets without permission.

  • Submit requests for services outside personal or business use without prior approval.

4. Revisions and Refunds

  • Revisions are provided only as specified in the SOW or LOA.

  • Minor adjustments to website builds before final delivery are included as outlined in the LOA.

  • Additional or major changes require a new SOW or LOA and separate payment.

  • Refunds are not offered outside the terms defined in the SOW or LOA.

5. Limitation of Liability

  • The Zephlex is committed to delivering services accurately according to the agreed package.

  • Occasional technical issues, downtime, or third-party service interruptions may occur.

  • Clients are responsible for the content they provide. The Zephlex is not liable for errors in client-provided materials.

6. Intellectual Property

  • The Zephlex retains ownership of pre-existing tools, templates, and creative assets used in delivering services.

  • Upon full payment, clients receive a non-exclusive, non-transferable license to use the final content or website for its intended purpose.

  • Any third-party materials provided by the client remain the client’s responsibility with regard to copyright compliance.

7. Privacy Policy

By using our services, you agree to the terms outlined in our Privacy Policy, which explains how your personal information is collected, used, and protected.

8. Governing Law

These Terms of Service, SOWs, and LOAs are governed by the laws of the State of California, without regard to conflict of law principles.

9. Modifications

The Zephlex reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated Effective Date.
